Terms and Conditions

Welcome to No.30 Whitby. Please take a moment to read our booking conditions and noise policy below as we want to ensure that all our guests have a wonderful and safe stay and also that our neighbours are not disturbed.

We will not refund any monies paid for a cancellation for a Force Majeure Event.

It is your responsibility to ensure that you have adequate insurance in place.

The following Terms and Conditions apply to your booking. They form the terms of a legally binding contract between us and you.

To proceed with your booking please confirm your acceptance of the terms and conditions by completing the form provided.

Contract

The contract for a short term holiday rental will be between the owners of No.30 Whitby (referred to as "us" or "we") and the person making the booking and all members of the holiday party (referred to as "you" or "your") under the following booking conditions. UK law will govern the contract. The contract of hire is not effective until we have received and processed the deposit. The contract will be subject to these booking conditions and must be complied with. The party leader must be at least 18 years of age at the time of booking and the booking form must list names and addresses and ages of your party.

Payment

Bookings are confirmed and a contract will arise on receipt of the terms and conditions acknowledgment and completed booking form with full details of all occupants and receiving the deposit of 25% of the holiday cost. Until this point the dates remain available. The balance of the rental will be due for payment 12 weeks before the start of your holiday. No.30 will construe non-payment of the balance by the due date as cancellation of the rental by the customer and reserves the right to cancel the holiday and make the dates available and the deposit will be forfeited.

The deposit required to secure a booking is 25% of the total cost of the agreed price. There will be a 7 day cooling off period after this is received.

The deposit paid is for the agreed dates, if you wish to change your booking to an alternative date before the balance has been paid it will be considered as a new booking and the deposit will be forfeited and you will be required to pay another 25% deposit for the cost of the new dates.

If the deposit and balance have been paid you are committing yourself to the agreed dates, a request to change the dates at such short notice may not be considered. In the event that we allow you to change your dates within the 12 weeks before your booking the deposit will be forfeited and you will be required to make a new booking.

Payments can be made by BACS or cheque, made payable to Mark Verity.

Cancellation by You

If you change your mind and would like to cancel your booking please contact us by email as soon as possible. Please note that any refund given to you when cancelling your reservation will not include your deposit, unless cancelled within the 7 day cooling off period.

If You cancel Your booking within seven days of receiving confirmation, we will refund the balance of any money you have paid Us including the deposit.

For cancellations made after 7 days of booking and 12 weeks prior to arrival 100% of the deposit will be retained.

For cancellations made within 12 weeks of the scheduled arrival date there will be no refund.

Any bookings cancelled after the balance has been paid, We will refund the cost of the balance paid in the event of the property being rebooked for the same price. If We book the property at a lesser price, We will retain the difference.

You will be reimbursed after the original check out date of the original booking.

All cancellations will be subject to a £60 administration fee.

We would strongly advise that guests take out a travel insurance policy. Should you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.

National Lockdown – In the event of a national lockdown that coincides with your holiday, where you are unable to travel, and we are prevented from opening, you will receive a full refund.

Regional/Local Lockdown – In the event that the address given on the booking is put into local/regional lockdown, rendering you unable to travel and the period of restrictions covers the period of your booking you will receive a full refund. Please note that this applies only to the address given on the booking of the lead Booker and does not apply if another party member at a different address is unable to travel due to local/regional lockdown.

Your inability (or the inability of any, some or all of your intended occupants) or disinclination to travel to and stay at your hired cottage for any reason. This includes – but is not limited to – illness (including Covid), a requirement or recommendation to self-isolate or quarantine, a call to jury duty, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport. These remain at your risk and do not give rise to a right to cancel or to receive a refund unless we re-let the property, other than according to the sliding scale below. You are strongly recommended to take out UK travel insurance to cover these eventualities. If you choose not to take out UK travel insurance then you accept responsibility for any loss that you may incur due to your cancellation.

Travel Insurance - It is the responsibility of the lead guest to acquire suitable travel insurance to cover their holiday, including cancellation and curtailment protection insurance. We strongly recommend that you take out suitable insurance which will cover you for possible cancellation of your UK holiday. There are several suitable options which include cover for COVID-related cancellation (see below), or you can look for suitable cover on comparison sites such as www.gocompare.com. We are not selling, promoting, endorsing or recommending any particular product, and do not benefit financially or have any formal relationship with any of these providers.

Cancellation by Us

No.30 will only cancel your booking if No.30 Whitby's performance is hindered and becomes unavailable due to circumstances beyond our control at our site - for example fire, flood, destruction/damage to the property or some other on site issue that effects the functioning of the house, then No.30 Whitby may at its sole discretion offer you;

A full refund;
Refund less deposit;
Alternative dates;
Other such remedy as No.30 Whitby considers appropriate with regard to the circumstances.

If No.30 Whitby has to terminate your holiday early for the above reasons we will refund part of the booking fee value based on the time remaining of the booking.

Whatever the circumstances our liability to you will not extend beyond a full refund. We shall not be responsible for any consequential loss.

Force Majeure

No.30 Whitby cannot accept responsibility or pay any compensation where the holiday let is frustrated in circumstances amounting to a Force Majeure event. In this contract between No.30 Whitby and you, the customer, a Force Majeure event means any of the following circumstances, which may hinder or prevent the performance of the contract including but not limited to:

Acts of God, flood, drought, earthquake or other natural disasters;
Epidemic or pandemic, general restrictions on movement imposed by local or National Government;
Terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo or breaking off of diplomatic relations;
Nuclear, chemical or biological contamination or sonic boom;
Any law or any action taken by a local or National Government or public health authority;
Collapse of buildings, fire, explosion or accident;
Any labor or trade dispute, strikes, industrial action or lockouts;
Non performance by suppliers or subcontractors; and interruption or failure of utility service.

We strongly advise that guests take out a travel insurance policy which covers booking cancellations. This is available at very affordable rates and gives you the peace of mind should you need to cancel your holiday. If you choose not to then you accept responsibility for any loss that you may incur due to your cancellation.

Liability

We do not accept any liability for any damage, loss, injury, sickness or inconvenience to any member of your party or any vehicles or possessions how so ever caused nor shall we be liable for any additional expenses incurred by you or your party, whether directly or indirectly caused by or arising from any aspect of your booking with us No.30 Whitby. Under no circumstances shall our liability to you exceed the amount paid to us by you.

Damages/Breakages

Please take care when staying in our property. You are responsible and liable for any breakages or damages which you cause to the accommodation or it’s contents. All we ask is that you report any incidents as they occur. We do not normally charge for minor breakages but we may send you an invoice for repair or making good if the damage or breakage is significant and we may make an additional charge if you did not report this. You will report without delay any breakdown of equipment or appliances so arrangements for repair or replacement can be made as soon as possible.

Anti-Social Behaviour

You agree not to act in such a way which might cause disturbance to any neighbouring properties. If we consider that you have behaved in an anti social manner, irresponsibly or have caused significant damage to the property or the property of others we are entitled to terminate your let with immediate effect and without refund.

Care of the Property

The client shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. Please remove all rubbish, unwanted personal items, food and drink from the house and place in the bins provided located down the side of the property. If you have lots of rubbish from your stay which doesn’t fit into the bins we kindly ask that you dispose of this excess at a local recycling centre. An additional charge may be made if extra cleaning is required. No.30 Whitby will check the condition and contents of the property and will notify the hirer within fourteen days of any additional cleaning costs or charges for damage and breakages for which the hirer is liable. Payment shall be made by the hirer immediately on receipt of the invoice in respect of the above charges.

Noise Policy

No.30 Whitby is in a residential area therefore we have neighbours who require respect. Please show consideration to the environment and our neighbours in all matters and especially with regard to noise in the early morning and late evening. In order to ensure the peace and quiet of our neighbours, music or other noise that can be heard outside the property is not permitted after 9pm and before 9am.

  • After 9pm and before 9am please use the courtyard as a quiet area.
  • Hot tubs are not permitted.
  • Please do not take sources of music or instruments outside the house. Please no public address systems or portable personal speakers to be taken outside or to emit noise from the premises.
  • Please do not turn up the volume of the music or TV within the property to provide music outside.
  • Please limit any music playing or TV noise inside the house so it cannot be heard outside.

Holiday Accommodation

No.30 Whitby is let as holiday accommodation and does not create a landlord tenant relationship within the meaning of the rent acts.

No.30 Whitby must not be sublet and the number of people using the accommodation must not exceed the maximum occupancy advertised or declared on the booking form.

The number of persons occupying the property must not exceed the number stipulated in the booking, unless agreed otherwise. The property will be used for personal and domestic purposes only. The property shall not be used for any commercial purposes without the written consent of No.30 Whitby. No.30 Whitby reserves the right to refuse entry to the entire party if these conditions are not observed.

Inspection and Maintenance

You must allow us access to the property at all reasonable times and in the case of emergency at all times with or without you present. You must allow us to access the property (with or without you being present) to deliver and collect laundry. It has been arranged for the exchange of laundry to happen before the property is let but occasionally may happen during the let due to unforeseen circumstances.

The guest is aware that the internet speeds can be variable due to location and local internet infrastructure and cannot seek compensation as a result of slow internet or technology that is reliant upon the internet to function properly.

There is CCTV installed on the front of the property this is to ensure site security and surveillance of the front entrance.

Fire Prevention

Smoking is not permitted in No.30 Whitby. No candles are to be lit in or outside the house or property at any time due to being a high fire risk. Also due to high fire risk we do not allow BBQs.

Cots and Highchairs

We provide 2 travel cots and 2 highchairs. Please bring your own cot linen.

Safety

Guests must accept responsibility for their own and their children’s safety inside the property and in the outside area at all times.

Arrival

You will have access to the house from 4pm on the day of arrival.

Departure

Please vacate the house by 10.00am on the day of departure.

COVID-19

All guests travelling must be free of Covid-19 and not in a period of self-isolation.

Any guest with Covid-19 should not check into the house.

Any guest developing symptoms should leave the property immediately to self-isolate at their own home. Should any guest attempt to self-isolate at the property all costs and compensations will be borne by you.

Stag & Hen Parties

We do not permit stag or hen groups to stay at No.30 Whitby.

Amendments by Us

We believe the information on our website to be honest and accurate but reserve the right to alter the details at any time.

Complaints

We truly hope that you will never need to complain but if there are reasonable grounds then you must inform us immediately (during your stay) so that appropriate action can be taken.
